I live in South Africa. I have a builder doing some remodeling for me (it's a bathroom). I paid him $2,000 for the work to be done and he hasn't completed it (its 70% complete). He also owes me another $2,000 for work not started (a second bathroom).
After giving him every opportunity to complete the job, he has said that the project will be delayed for a few more weeks as he has run out of money. He has committed himself to complete the job as he gets money from other work. Even though I paid him in full (my mistake, yeah), I am faced with the choice.....

Lay a case of fraud at the local authorities against him. This will probably mean that he will lose his house and his wife. He has 2 young kids at school too.

Keep on keeping on and give him a chance to complete the work (slowly) as he has money.
I am conflicted, because the human in me can't bear to see a man lose his family and his kids go through this. The realist in me wants to tear him a new one though.
My wife is of the opinion that we lay a case of fraud (because there are grounds for fraud). This would however, apart from destroying his life.... cause the work and the money he owes me to come to a complete stop.
Any realistic suggestions welcome.
